Big Changes in DUI Laws and How They Affect You

It used to be that a person charged with a DUI would have to be proven in court as guilty because he or she was driving improperly or dangerously due to impairment. Not so anymore. Because of a new “per se intoxicated law”, any driver with a blood alcohol content of over .08% is charged with DUI. That means you don’t have to be necessarily impaired to be charged with a DUI in Arizona!
What is Implied Consent?
If you have an Arizona driver’s license, you have already impliedly consented to submit to a chemical test if asked by police. If you do not submit to chemical testing, you will face losing your driver’s license.
Enhanced Penalties Due to High BAC Levels
If your blood alcohol content was at least .15% while driving, this is considered grounds for enhanced penalties because you were so far over the state’s legal limit of .08%. From harsher fines to more jail time, the penalties are severe.
Arizona’s Zero Tolerance Law
If you’re under 21 and you registered any amount of alcohol in your blood alcohol content, you are DUI. Like an adult charged with a DUI, the penalties are serious.
What Happens to Your Driver’s License?
In Arizona, you will lose your license for 90 days for a first, second or third offense. The judge will also order you to enroll in mandatory alcohol education classes and seek alcohol treatment. For a second DUI offense, the judge can order an ignition interlock device to be installed in your car at your expense. This machine won’t allow your car to start until you blow into the device with no alcohol on your breath. For a third DUI offense, the judge can order your vehicle to be confiscated. After heavy fines and administrative fees, you can receive your vehicle back.
