Like many Arizona drivers, DUI laws and proceedings are not something you think about on a regular basis. What many drivers don’t realize is that a DUI charge in Arizona actually brings on two separate charges. The first and probably most obvious is the criminal proceeding in court. The second is a civil proceeding with the Arizona MVD (the Department of Motor Vehicles).
Both of these proceedings apply to you if took a chemical test (blood, breath or urine) and failed by going over the state’s limit of .08% or you refused to submit to testing. The civil proceeding deals directly with your driver’s license. The state will seek to take this away from you.
When you are arrested for DUI, the officer will give you a Notice of Suspension. If your BAC measured over .08% within two hours of driving, the officer will serve you with 90-day driver’s license suspension notice. If you refused the test, it will be a 12-month suspension.
If you failed the chemical test, the officer will issue you a 15-day temporary driver’s license. If you request a hearing with the MVD within the 15-day window, your license will be valid until the hearing date. To request a hearing with the MVD, you must submit it in writing. Most likely, you’ll use the pink slip of paper police gave you to request the hearing. It must be mailed within 15 days of your arrest date; remember to fill out all the information. When you are finished, the police will mail your hearing request to: Arizona Department of Transportation, Executive Hearing Office, Mail Drop 507M, P.O. Box 2100, Phoenix, AZ 85001-2100.When the police take your driver’s license, they will give you a yellow slip of paper. Consider this your new license and take it with you.
