You’ve been arrested for a DUI and you’re not going to lie – you’re scared. But information is power and we’d like to help you understand exactly what you’re up against. Basically an Arizona DUI does not result in the same penalties for everyone. Depending on the type of DUI you were charged with and your criminal record, the penalties can vary from person to person. Take a look:

For a first offense or a BAC above .08% you’re subject to:
  • License suspension for 90 days by the MVD
  • Fines: $250 and a surcharge; $500 assessment for DPS and $500 for the Arizona Prison Construction Fund
  • Alcohol assessment and treatment and probation for up to 5 years
  • Jail: 10 consecutive days. If you agree to submit to treatment and get an alcohol/drug evaluation, the court will suspend 9 days
If you’re BAC was over .15% you’ll face:
  • 90 days license suspension
  • Fines: $1000 for DPS assessment and $1000 for the Arizona Prison Construction Fund; $250.00 fine, plus a surcharge, plus an additional $250.00 assessment to the Arizona DUI abatement fund
  • The installation of an ignition interlock device and up to 5 years probation
  • 30 consecutive days in jail; 20 days can be suspended if you agree to alcohol treatment
If it’s your second DUI offense or your BAC was over .08% you’ll face:
  • Revocation of your license for 1 year
  • A $500 fine, a surcharge, a $250 assessment to the Arizona DUI abatement fund and a $1250 assessment if you were arrested after March 13, 2004
  • The installation of an ignition interlock device and up to 5 years probation
  • 90 days in jail; 60 days will be suspended if you agree to alcohol testing/treatment
Felony DUI (This applies if you’ve had 3 DUIs in 5 years or a DUI with a suspended or restricted license)
  • Driver’s license revoked for 3 years, vehicle confiscation and probation up to 5 years
  • Up to $150,000 in fines! This doesn’t include a surcharge, $250 assessment to the Arizona DUI abatement fund, plus $1500 for arrests after March 13, 2004
  • A minimum of 4 months in prison before you can seek probation, pardon or any other reason for release
